A native Texan, Joshua Iacuone practices law in Texas and around the country. He co-founded Iacuone, McAllister & Potter PLLC (IMcP) as the premier “go to” law firm fighting for the rights of executives, financial advisors, employees, and partners.

Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization since 2013, Joshua has intentionally focused his practice to helping the individual.

While a valued and creative counselor to clients in negotiations and dispute resolution efforts, Joshua is a fierce advocate when and if litigation is unavoidable. Picking juries in state and federal court, and trying numerous lawsuits and arbitrations, Joshua thrives in the adversarial “heat of battle”. With an attention to detail and careful preparation, he especially locks-in on the cross-examination of the opposing party and key adverse witnesses. Few things are as effective in trial as the methodical impeachment of the other party on the stand under the glare of a jury’s intense focus.

In addition to lessons learned from trial work, as a FINRA arbitrator, Joshua has a unique view and insight into the mind and analytical process of the ultimate decision-makers in any dispute. With this knowledge and experience, and tailored to the unique audience of every case, he–in the earliest stage of a case–crafts the vision for “themes” and “narratives” necessary to tell a compelling and winning story, as well as the plan of action to secure the evidence necessary to solidify them.

For nearly his entire career, Joshua has maintained a special focus on helping financial advisors, including trying FINRA arbitrations to final Award, assisting with FINRA 8210 investigations and FINRA On The Record (or OTR) interviews, and navigating internal “investigations” by a Firm’s HR or compliance departments. He has also helped move numerous financial advisors and teams to new Firms, including negotiating the terms of new deals with front-ends and backends, dealing with a prior Firm’s “nasty letters” about client solicitation (either inside or outside of the Protocol for Broker Recruiting), repayment of promissory notes, and arbitrating defamation, FINRA U5 “weaponization,” and compensation forfeiture disputes with the old Firm.

Whether on the front-end (with the employment agreement terms and compensation) or back-end (with the severance agreement and exit terms), Joshua provides key guidance for the entire lifespan of an employment relationship for executives, financial advisors, partners, and employees. Sometimes exits can be delicate with claims of impropriety or criminal behavior. Sometimes exits can be complicated given RSUs, PSUs, and Change in Control “trigger” fights. No two situations are alike, so early on, Joshua crafts a unique action plan to maximize leverage for his clients.

In recent years, Joshua proudly represented brave women in highly charged sexual harassment or unfair treatment claims. Usually, these involve relationships with superiors who abused their positions, treating the office as a hunting ground to prey on vulnerable co-workers. Aware of these delicate, and sometimes embarrassing, situations, Joshua carefully navigates them in both pre-suit negotiations and – if necessary – litigation, but always fighting for the client to be made whole and fairly treated for the damage inflicted by office predators.

Joshua is blessed with a practice focused on referrals from past clients and opposing counsel, and is always mindful of and humbled by the faith entrusted to him with such crucial problems and at such vulnerable times in his clients’ lives.

Following law school, Joshua completed a one-year federal judicial clerkship with the Chief Judge of the Eastern District of Texas. He then honed his trial skills at two well-respected litigation law firms in Dallas, Texas, focusing on trial law, employment law, and financial advisor law.

When not working, Joshua burns all of his energy chasing after his young daughter Evangeline, and sharing a love of travel and pilates with his brilliant wife Crystal.

Texas Monthly has rated Joshua a “Super Lawyer” for every year he’s been eligible, and voted Joshua a Top 100 Lawyer in Texas under the age of 40 in 2017 (sadly, he is no longer under 40).
