Bankruptcy, Receivership, and Financial Institutions
Bankruptcy
IMcP represents debtors, creditors, trustees, institutional lenders, equity holders, and other major constituencies in bankruptcy cases across the country, including those pending under Chapters 7, 11, and 13 of the Bankruptcy Code. These cases include representation of clients in complex corporate Chapter 11 cases, as well as related litigation and adversary proceedings. In connection with its bankruptcy practice, IMcP also represents clients in connection with out of court workouts, restructurings, and other insolvency related matters. Our experience allows us to provide a strategic evaluation of each matter, with a tailored approach to the representation from the beginning, and throughout each step of the process.
IMcP received nationwide media attention for our bankruptcy litigation in 2024-25 (see our Blog/News page).
Receivership
In addition to serving as a court-appointed Receiver, IMcP’s Joshua Shepherd also routinely represents Receivers, Property Monitors, Liquidating Trustees, and other court-appointed agents. Whether liquidating assets, prosecuting fraudulent transfers, operating a business, or preserving the estate, Mr. Shepherd’s Receivership practice involves cases pending in state, federal, and family law courts. As a Receiver or counsel to a court-appointed agent, Mr. Shepherd has experience handling matters in a wide array of industries, including life-settlements, oil and gas, skilled nursing, real estate, direct sales, textiles, and transportation.
Financial Institutions
IMcP has extensive experience representing banks, credit unions, and other financial institutions in lawsuits, arbitrations, and related litigation, as well as in connection with out of court workouts and debt restructurings. Our attorneys have represented financial institutions in employment litigation (noncompetition, discrimination, and whistleblowers), internal investigations, and matters involving customers, borrowers, and guarantors. When a loan or credit facility becomes problematic, IMcP’s Joshua Shepherd has extensive experience representing and advising financial institutions with their collections and/or debt restructurings, whether through litigation, bankruptcy proceedings, or out of court workouts.
